Maryland Governor’s Blind Trust & Nonparticipation Agreement
In 2025, the General Assembly passed HB 932 (CH 300) requiring the Governor to place certain interests into a certified blind trust approved by the State Ethics Commission and enter into a Nonparticipation Agreement for any interests held by the Governor that are not included in the blind trust. The specific provisions related to these requirements are found in §5-501.1 of the Maryland Public Ethics Law. Additional blind trust requirements are set forth in the Commission’s regulations in COMAR 19A.06.

Effective October 1, 2026, the State Ethics Commission is required to post the Governor’s approved certified blind trust documents and Nonparticipation Agreement. (Md. Code Ann., §5.50-1.1(b)(3), Gen’l Prov. (Supp. 2025))

Additionally, beginning on 10/1/25, the Governor is required certify to the State Ethics Commission annually by January 31st each year that the Governor has:
- Obtained no new interests in the immediately preceding year that are not included in the blind trust; or
- Entered into a nonparticipation agreement with the Ethics Commission for any new interest obtained in the immediately preceding year that was not included in the blind trust.
